Mailbox Power Influencer Affiliate Agreement

Mailbox Power may offer you an opportunity to become an independent Mailbox Power Influencer Affiliate (“Affiliate”), wherein you have the opportunity to earn additional money for Mailbox Power products, services, and accounts that you sell. Mailbox Power reserves the sole and exclusive right to determine the amount of remuneration each Affiliate will receive in exchange for the Affiliate’s efforts. Affiliate commission is further discussed herein. See also Mailbox Power’s Terms of Service at www.mailboxpower.com, which apply to you in your role as Affiliate, unless otherwise expressly provided for.

This Affiliate Agreement (“Agreement”) governs your application for, and any subsequent participation in, Mailbox Power’s Affiliate program. By clicking “I Accept the Terms and Conditions” and submitting, you accept the terms of this Agreement and agree to be bound by its terms.

SECTION 1 - PARTIES

All references to “Mailbox Power” herein mean and refer to Mailbox Power, LLC, a Utah limited liability company. All references to “You” and “Your” mean and refer to the person or entity who has executed this Agreement. Mailbox Power and You are each referred to as a “Party” and collectively as the “Parties.”

SECTION 2 - APPLICATION

You agree to provide all information requested by Mailbox Power in connection with Your Affiliate application, and You affirm that all information provided is truthful and accurate. Mailbox Power retains sole discretion to determine qualification for participation in the Affiliate program. Not all applicants will qualify.

SECTION 3 - CONSENT TO BE CONTACTED

You expressly consent to be contacted at the email address and phone number you provide, including via automated dialing systems, texts, and artificial or pre-recorded messages. This consent is a material condition of this Agreement and may not be revoked except in writing by both Parties.

SECTION 4 - COMPENSATION
  • If your application is approved, you will receive a unique Affiliate ID used to track your referrals.
  • You may receive commission for each membership sale registered using your Affiliate ID, provided the account remains in good status for 30 days post-sale.
  • Commissions are paid on the 10th of each month for qualifying transactions. If the 10th is a weekend or holiday, payment will be on the next business day.
  • For annual memberships, commissions are paid in monthly installments over the membership term.
  • All commissions are based on net revenue received by Mailbox Power and exclude taxes.

Affiliate Commission Plan:

  • 20% commission on all recurring Birthday, Pro, or Executive membership sales.
  • 10% commission on Birthday, Pro, or Executive membership sales sold by personally enrolled Affiliates.

Commissions are paid in USD or other currencies offered by the payment provider. Payment methods may incur processing fees. You must reach a minimum combined commission of $100.00 (USD) before receiving a payment. Commissions not exceeding $100 within 120 days are forfeited.

Registration with a third-party payment provider and completion of required tax forms is necessary to receive commissions. U.S. non-residents may have tax withheld. You are responsible for compliance with all applicable tax laws.

  • Commissions are not paid for payments made on your own user account(s).
  • One Affiliate account per household.
  • No commissions for sales found to be fraudulent or violating this Agreement or law.

If a payment is refunded or charged back, any paid commission may be deducted from future commissions.

SECTION 5 - TERM AND TERMINATION

The term of this Agreement begins when you accept the Terms and Conditions or when you are approved for the Affiliate program. Either party may terminate the Agreement at any time with 30 days' written notice. Mailbox Power may terminate the Agreement without notice if you fail to comply with any term or law, or if your dispute rate exceeds 10%. If terminated or canceled, you forfeit all unpaid commissions. This Agreement will also terminate automatically if no commissions are earned over 12 months.

Provisions that should survive termination, such as liability limitations, disclaimers, indemnity, and arbitration, will remain in effect.

SECTION 6 - ADDITIONAL REPRESENTATIONS AND WARRANTIES

You represent that there are no current or pending government investigations or lawsuits against you related to advertising or consumer protection. If you become subject to such proceedings, you must notify Mailbox Power within 24 hours. Mailbox Power may terminate your participation at its discretion.

SECTION 7 - ENTIRE AGREEMENT

This Agreement, Appendix A below, and Mailbox Power’s Terms of Service are the entire agreement regarding your Affiliate application, rights, and responsibilities.

Appendix A: Additional Terms and Advertising Rules

General Compliance
  • All advertising must comply with laws regarding deceptive and misleading advertising, email marketing, and testimonials (including FTC guidelines).
  • No claims may be made that are inconsistent with Mailbox Power’s official materials.
  • Prohibited advertising channels: telemarketing, fax, text messaging.
  • No monetary incentives may be offered to obtain sales. Only genuine information or materials of value may be provided, if delivered as promised.
Disclosure

You must disclose your Affiliate status on any website where you advertise Mailbox Power services or products.

Non-Disparagement
  • No negative comments or comparisons about Mailbox Power or competitors.
  • No unlawful or deceptive search engine optimization tactics.
  • No direct linking to Mailbox Power sales pages from paid ads.
Income and Business Opportunity Claims
  • No claims may be made that using Mailbox Power guarantees income.
  • Any income claim must be true, accurate, and accompanied by this disclaimer:
    “These were my results. Your results will vary based on a variety of factors including your education, effort, and market factors. There is no guarantee you will make any money.”
  • No claims that Mailbox Power is a business or franchise opportunity.
Mailbox Power Trademarks
  • Affiliates may use “Mailbox Power™” to advertise online, but may not use it or other trademarks as part of any URL or website name.
  • All trademarks remain the exclusive property of Mailbox Power.
Complaint Notification

Notify support@mailboxpower.com within 24 hours of any complaints about your advertising.

Independent Contractor

Affiliates are independent contractors, not employees or agents. You cannot bind Mailbox Power or share in its profits or losses beyond commission.

NO WARRANTY; NO LEADS

Mailbox Power does not guarantee business success, income, or leads. This is not a business opportunity or assisted marketing plan.

LIMITATION OF LIABILITY

Mailbox Power is not liable for indirect, special, incidental, punitive, or consequential damages related to this Agreement, products, or services. Maximum liability is the greater of three times the amount paid by you in the prior month or $2,000.

Indemnity

You agree to indemnify and hold harmless Mailbox Power from any claims or actions arising out of your conduct or breach of this Agreement.

Severability

If any provision conflicts with law, it is modified to comply and the Agreement remains in effect.

Modification/Amendments

Mailbox Power may modify this Agreement or Terms of Service at any time. Continued acceptance of commission payments constitutes acceptance of changes.
